    President's Message
    David H. McClain, ABC President

The ABC Board of Trustees would like to extend special thanks to Cooper Gay, Fitzpatrick & Hunt, our administrative staff, and all of the ABC insureds, brokers and underwriters who helped make 2011 another successful year for the program. Our Fall Conference in Boston was again very well attended, and the feedback we received strongly supported having future conferences in cities like Boston. The 2011 Fall Conference covered important developments with major aviation manufacturers like Airbus and Sikorsky, the “Regulator’s Perspective” from the FAA’s Peter White, as well as topical presentations on the future of composites, MRO operations and emergency preparedness response. Please mark your calendars for the 2012 Fall Conference, September 23-25 at The Ritz-Carlton, Naples, in Naples, Florida (for information, see http://www.aircraftbuilders.com/conference.html).

    ABC Brokers Report
    David Sales, ABC Brokers Committee

The soft conditions continue to bring volatility across the whole of the aviation insurance market. The pertinacious surplus of hungry capacity suggests that this volatile state will persist for the foreseeable future.

Legal Update: Revised Rules for Federal Removal Take Effect in 2012
Alan H. Collier and Jennifer Vagle of Fitzpatrick & Hunt, Tucker, Collier, Pagano, Aubert, LLP
On December 7, 2011, President Obama signed into law the Federal Courts Jurisdiction and Venue Clarification Act of 2011, H.R. 394, P.L. 112-63, 125 Stat. 758 (the “Act”). The Act amends the federal jurisdiction and venue statutes by clarifying the courts of original jurisdiction for cases involving corporations or resident aliens, altering the rules for venue determinations, and—significantly for aviation defendants—revising the judicial procedures for removing state court cases to federal court. The Act will apply to all actions commenced on or after January 5, 2012, and it will require defendants to reexamine their removal strategies in light of its changes.
